Question: If an officer asks if I have a needle or other drug-related sharp object on me prior to conducting a search, will I be charged with possession of drug paraphernalia if I disclose that I have a needle in my pocket? Answer: No, the law protects an individual from being charged with possession of drug paraphernalia when a needle or other drug-related sharp object is disclosed to the officer prior to a search being conducted. We want to make sure everyone is safe, including our officers, and it is important to let us know about the presence of needles or other dangerous items prior to a search being conducted.
