Marco Munoz
Marco Munoz, 58, was charged on Feb. 3 with incest, rape and possession of matter depicting a sexual performance involving a minor aged 12 to 18. The charges relate to Munoz allegedly engaging in sexual acts with the victim, both as a minor and when the victim was 18. Munoz has been held at the Woodford County Detention Center since his arrest.
The Sun does not identify the names of victims of sex crimes.
Munoz was arraigned in Woodford County District Court on Feb. 9, when he was appointed a public defender and entered a plea of not guilty.
The specific allegations are set out in a Criminal Complaint Warrant filed by Versailles Police Detective Derek McKibben.
According to the complaint, on Oct. 7, 2024, when the victim was 17, Munoz and his wife began fostering the victim. On July 24, 2025, Munoz and his wife’s adoption of the victim was finalized in Woodford District Court. They also fostered another child, 17, during this time.
Video accessed from Munoz’s cellphone allegedly showed him and the victim engaging in sexual intercourse at their home in Versailles on Dec. 13, 2024. Two other videos obtained by VPD depict them allegedly engaging in sexual acts on July 24, 2025, after the alleged victim turned 18.
In a Petition for Protective Order filed against Munoz, following several calls by Munoz to the victim’s cellphone that was in the possession of VPD while he was in the detention center, the victim said Munoz’s unwanted sexual abuse continued until Jan. 31, 2026.
Woodford Family Circuit Judge William Fooks granted a temporary protective order pending a hearing for a permanent one.
VPD became aware of a possible crime when the victim tested positive for a sexually transmitted disease (STD) administered by the Woodford County Health Department in October 2025. Munoz tested positive for the same STD in Nov. 2025. This led McKibben to obtain a search warrant and to seize Munoz’s phone, which contained the images of the victim being sexually abused as a minor and as an adult.
According to the Petition for a Protective Order filed against Munoz by the victim on Dec. 3, 2025, VPD arrived at their home and removed the other foster child. Following the departure of the police, the victim claimed Munoz instructed the victim to lie to the police about any sexual activity between them.
Munoz was scheduled to appear in court on Wednesday, Feb. 18, for a preliminary hearing, when the district judge will decide if there is sufficient probable cause to send to the Woodford County Grand Jury.
The Grand Jury will determine if Munoz will be indicted on any the alleged charges. In the interim, Munoz will remain in the detention center unless he is able to meet the bond conditions.
“VPD is conducting an ongoing investigation, looking into all aspects of this case, including whether there are any other alleged additional victims,” VPD Chief Rob Young said. “If there are other victims regarding this matter, they are encouraged to contact Det. McKibben at 859-873-3126.”
