The Woodford County Commonwealth Attorney’s office presented two high profile cases before the Woodford County Grand Jury on March 11, which resulted in multi-count indictments in both cases. Commonwealth v. Marco Munoz and Commonwealth v. Jai Burgess appear to be unrelated, but this is a continuing story the Sun is closely following.
Marco Munoz
As reported previously by the Sun, the Versailles Police Department conducted an investigation based on a statutorily required report from the health department that Munoz and his adopted daughter, who had been previously fostered by he and his wife, had contracted the same sexually transmitted disease. The police then discovered evidence of sexual acts between him and his daugher, while she was a minor, on electronic devices owned by him. He was then charged with a variety of related crimes.
The grand jury returned three seperate indictments. The first charges him with: two counts of incest, and single counts of rape, possession of matter portraying sexual performances of a minor between the ages of 12 and 18, sodomy, unlawful transaction with a minor, and the use of a minor in a sex performance. The victim is identified by the initials N.M.
Munoz was charged in a second case of one count of possession of matter protraying sex performance by a minor between 12 and 18 that virtually depicted an actual sexual performance by a different victim than that of the other case. The victim here is identified by the initials A.G.
Finally, Munoz was charged in a third indictment with four counts of possession of matter portraying sex performance by a minor between the ages of 12 and 18, one count of distribution of matter portraying sex performance by a minor between the ages of 12 and 18, and one count of video voyeurism by recording the sexual conduct, genitals or nipple of a female breast and then distributing the images. The victim here is identified by the initials J.H.
The Commonwealth Attorney’s Office declined to comment as it is a pending case and an ongoing investigation. Munoz will be arraigned on April 1, 2026.
All three cases are pending before Woodford County Circuit Judge Kathryn Gabhart.
Jai Burgess
The Sun previously reported on the investigation and arrest of Jai Burgess in a shooting incident on Macey Avenue, and two instances of domestic assault. However, the indictement in this case relates to various sex crimes involving a minor identified by the initials J.H. The Commonwealth Attorney’s Office declined comment, and specifically whether the victim J.H. is the same person in both the Munoz and Burgess cases.
Burgess was charged with two counts of use of a minor under 16 in a sex performance in which the victim incurred a physical injury, two counts of unlawful transaction with a minor under 16, and two counts of promoting sexual performance by a minor under 16.
Burgess will be arraigned on April 8, 2026. His case is pending before Woodford County Circuit Judge Jeremy Mattox.
