The Board of Adjustment (BOA) approved a conditional-use permit that allows Jeff and Piper White to operate a private club at 133 Macey Boulevard. The Whites had operated a private club in the former church building – without complaint from neighbors – since March 2013. However, a new conditional-use permit was necessary after the BOA approved a permit last month for a church to operate in the building located in a residential zoning district. The church interested in leasing the building for its services no longer wanted to locate its services at 133 Macey Boulevard. So Piper White returned to the BOA on Monday night in order to continue operating a private club in the former church building. As a condition of the permit, White agreed to not allow any alcohol at the social and charitable events, which will include birthday parties, weddings, Bible studies, business meetings and reunions. No outside activities (after 10 p.m.) or on-street parking (at any time) are permitted under additional conditions of the permit. Variances approved The BOA approved a variance so John Clark can build a single-family residence at 816 Germany Road. The 150-foot variance was necessary because the legal, nonconforming lot does not have public road frontage. It does have an access easement to Germany Road. Questions related to the ownership of the lot at 816 Germany Road and the legality of an access easement on an adjoining property were not relevant because the BOA was only asked to act on the request for a road frontage variance and nothing more, board Chair Tim Turney told two neighboring property owners who voiced those concerns. Clark told the BOA that he planned to access the property at 816 Germany Road using an old county road, which has been abandoned. One of the conditions of the variance approval was to ensure the access road was maintained and wide enough so emergency service vehicles can get to the site of the planned single-family residence. BOA member Marjorie Evans voted against approving the variance. Edith Tandy was granted side-yard variances so she can move forward with plans to build an attached garage on an existing footer at 415A Elm Street Heights. The BOA also approved a variance so Robert L. Bishop Jr. can build a 48-inch-high aluminum fence (along Barroway Lane) at 212 Helmsley Lane. Evans voted in opposition to approving the variance because of her concerns about the BOA continuing to set a precedent that allows a fence of this height.
