CITY OF MIDWAY
ORDINANCE NO. 2021-002
AN ORDINANCE REDUCING THE CITY’S BOUNDARIES BY 33.021 GROSS ACRES, WHICH
IS PART OF THE PROPERTY OWNED BY HOMER MICHAEL FREENY, JR., TRUSTEE OF
THE HOMER MICHAEL FREENY, JR. TRUST U/A DATED November 16, 2001, LOCATED
AT KENTUCKY HIGHWAY 341 – GEORGETOWN ROAD THAT IS CURRENTLY WITHIN THE
CITY’S BOUNDARIES
WHEREAS, Homer Michael Freeny, Jr., Trustee of the Homer Michael Freeny,
Jr. Trust U/A dated November 16, 2001, is the owner of a tract of
property adjacent to the Midway City limits and adjacent to Midway
Station (“Freeny Tract”); and
WHEREAS, pursuant to Ordinance No. 2019-001, the City annexed the Freeny
Tract into the City’s boundaries; and
WHEREAS, Freeny and the City desire to remove that part of the Freeny
Tract more particularly described at Exhibit A and hereinafter called
“1132 Georgetown Road,” from the City’s boundaries because both parties
desire for that part to remain on septic sewer; and
WHEREAS, the City followed the procedure in KRS 81A.440 to state its
intention to remove 1132 Georgetown Road from the City’s boundaries
through Ordinance No. 2021-002, sent notice of its intention to the
County Judge Executive, and there was no objection from the County Judge
Executive.
NOW, THEREFORE, be it ordained by the City of Midway, Kentucky, as follows:
Section 1.  The  City of Midway hereby removes 1132 Georgetown Road,
that includes 33.021 acres, and being more particularly described in the
attached Exhibit “A” from the City’s boundaries.
Section 2.  It is desirable by the City of Midway to remove the property
described in Section 1 above from the City’s boundaries because the
parties both desire for that part to remain on septic sewer.
Section 3.  No part of the Exhibit A is currently inhabited.
Section 4.  The County Judge Executive did not object to the City’s
intention to reduce its boundaries.
Section 5. This Ordinance shall become effective after passage.
Introduced and given first reading at a meeting of the City Council of
the City of Midway, Kentucky, held on the 15th day of March, 2021, and
fully adopted after the second reading at a meeting of said Council held
on the 5th day of April, 2021. Council Members voted: Gallagher-Yes,
Hicks-Yes, Nance-Yes, Raglin-Yes, Thurman-Yes.

STREET PAVING SPRING 2021
WOODFORD COUNTY, KENTUCKY
Sealed bids for the following work will be received by Midway City Hall,
101 E. Main Street, Midway, KY 40347, until 2:00 p.m. EDT (local time)
Wednesday, 4/28/2021 for furnishing labor and materials and performing
all work as set forth in this Advertisement for Bids, General
Conditions, Special Conditions, Specifications, and/or Drawings prepared
by HMB Professional Engineers, Inc., 3 HMB Circle, US 460, Frankfort, KY

Immediately following the scheduled closing time for the reception of
bids, all proposals which have been submitted in accordance with the
above conditions will be publicly opened and read aloud inside City Hall
with COVID-19 protocols in place (masks required).
The work to be bid upon is described as follows:
• Asphalt overlays will be conducted on 1st and 2nd Street aprons.
  The total area for 1.5” asphalt
  overlay is approximately 194 SY.
• Asphalt mill and inlays will be conducted on Martin Street and
  W Stephens St. The total area
  for 1.5” mill and inlay is
  approximately 5442 SY.
• Asphalt paving will be conducted
  in the Midway Cemetery. The total
  area for 8” DGA, 2” base course,
  and 1.5” surface course paving is
  approximately 228 SY.
• All work will follow KYTC
  specifications.
• Time allowed for completion of
  the Project is 30 consecutive
  calendar days.
Drawings, Specifications and Contract Documents may not be examined in
person due to the ongoing COVID-19 pandemic.

After award of a contract, the General Contractor will be furnished,
without charge, two (2) sets of plans and specifications.
Subcontractors, manufacturers, and suppliers shall obtain plans and
specifications from the General Contractor.
Work is expected to take place in the month of June, 2021.
Sealed proposals for the Contract shall contain 1 copies of the bidding
documents and be clearly marked on the outside of the container as follows:
“Sealed proposal for CITY OF MIDWAY – STREET PAVING SPRING 2021. Not to
be opened until 2:00 p.m. EDT (local time), Wednesday 4/28/2021.

Bids shall be submitted to City of Midway City Hall, 101 E. Main Street,
Midway, KY 40347. City Hall is open M-F from 8:30 a.m.- 4:30 p.m. If
delivered outside of business hours, bids shall be placed in the dropbox
on the front door.
If forwarded by mail, the sealed envelope containing the proposal must
be enclosed in another envelope and mailed to the City of Midway City
Hall, 101 E. Main Street, Midway, KY 40347, allowing sufficient time for
such mailing to reach this address prior to the scheduled closing time
for the receipt of proposals.
Bids shall be accompanied by a certified check or bid bond payable to
the City of Midway in an amount not less than ten percent (10%) of the
base bid. No bidder may withdraw his bid for a period of ninety (90)
days after the date bids are opened. He may, however, withdraw his bid
at any time prior to the time and date scheduled for opening of same or
any authorized postponement thereof. Any bid received after the time and
date specified will not be considered and will be returned unopened to
the bidder.
The City of Midway reserves the right to reject any and all bids and to
waive formalities and any bid that is obviously unbalanced may be rejected.
Bidders must comply with the President’s Executive Order Nos. 11246 and
11375, which prohibit discrimination in employment regarding race,
creed, color, sex, or national origin. Bidders must COMPLY WITH Title VI
of the Civil Rights Act of 1964, the Anti-Kickback Act, Section 3
Segregated Facilities, Section 109 and the Contract Work Hours Standard Act.
Federal law prohibits discrimination on the grounds of race, color,
national origin, religion, age, handicap, and sex in this project.

SIDEWALK REPLACEMENT PROJECT
The City of Midway, Kentucky, invites construction bids for the Midway
City Sidewalk Repair Project, which includes removing and replacing of
sidewalks within the City limits of the City of Midway.
Locations for sidewalk removal and replacment will take place are:
345 Northridge Drive, 344 Northridge Drive, 209 W. Stephens Street, 212
S. Gratz Street, 124 W. Main Street, 121 W. Bruen Street, 119 N. Turner,
111 W. Main Street.
Removal and installation of sidewalks shall be performed using
contractor’s best efforts to save and minimize damage to any street
trees affected by the project.
Bid proposals will be received by the City of Midway at City Hall, 101
East Main Street, Midway, Kentucky 40347, by NOON 12:00 p.m. local time
on April 28, 2021.  At that time and place, the sealed bids will be
publicly opened and read aloud.
Envelopes containing the bids must be sealed and addressed to City of
